Terms and Conditions of Read Legend

Welcome to Read Legend, a service provided by Legend Innova LLC.

These Terms and Conditions govern your use of the Read Legend mobile application and website.

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1. Description of the Service

Read Legend is a subscription-based service that offers interactive stories and images generated by artificial intelligence (AI), allowing users to choose their own path through story adventures and personalize creative content.

The Service is provided via mobile apps and a web-based platform.

2. User Requirements & Eligibility

You must be at least 13 years old to register for and use the Service.

If you are under 13, you must have verified parental or guardian consent and use the Service under adult supervision.

Parents or guardians are responsible for supervising minors' use of the Service and reviewing content for appropriateness.

The Service is intended for personal, non-commercial use unless otherwise stated below.

3. Account Registration & Security

To access interactive features and manage your subscription, you must create an account.

You agree to provide accurate, complete, and up-to-date information during registration.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Subscription & Payment Terms

Read Legend offers monthly and annual subscription plans.

Payments for mobile apps are processed through Apple App Store or Google Play Store.

Payments for the web version are processed securely through a third-party payment provider (e.g., Stripe). We do not store your complete payment card details.

Your subscription will automatically renew unless canceled before the end of the current billing cycle.

No refunds will be provided for subscription payments already processed.

You may cancel your subscription at any time via your account settings in the app or on the web platform.

Each subscription plan or trial permits up to one hundred (100) chapter generations per calendar month, subject to service availability. This limit applies cumulatively across all user profiles associated with a single account. The monthly limit resets automatically on the first day of each calendar month. Unused chapter generations do not roll over to subsequent months.

5. AI-Generated Content License & Attribution

Model and Service Attribution

Stories in this Service are generated using the Claude AI assistant, developed by Anthropic, via the Claude API service.

Usage Rights and Restrictions

Personal Use: AI-generated stories are intended for personal entertainment and educational purposes.

Limited Commercial Use: Limited personal commercial use (e.g., sharing personal creations online) is permitted. Mass commercial reproduction or distribution is not allowed without written permission from Read Legend.

Supervised Use by Children: While we take measures to ensure age-appropriate content, the generative nature of AI systems means that parental supervision remains important. We recommend that children under 13 use the Service under adult supervision and that adults review generated content before sharing it with younger children.

No Guarantees: We do not guarantee that generated content will be unique, original, accurate, or suitable for any specific purpose. Content may contain factual errors or inconsistencies.

User Responsibility: You are responsible for reviewing and editing generated content before using it for any purpose. The Service is a creative tool, not an authoritative source of information.

6. Image Generation License & Attribution

Model and Service Attribution

Images in this Service are generated using the FLUX.1 [schnell] model developed by Black Forest Labs, via the getimg.ai API service. The model is licensed under the Apache License, Version 2.0, and generated images are governed by the CreativeML Open RAIL-M license.

Usage Rights and Restrictions

Generated images are provided under the terms of the above licenses. Users should respect these terms when using generated images for personal or commercial purposes.

7. Intellectual Property Rights

Unless otherwise stated, Legend Innova LLC and/or its licensors own all intellectual property rights in:

The Read Legend app software
Website content
Logos, trademarks, and branding
Non-AI generated content

All rights are reserved.

You may access the Service for your personal use subject to these Terms.

You may not:

Copy, reproduce, distribute, or create derivative works from Service content without authorization
Sell, rent, or sub-license Service content
Use Service content for mass commercial purposes without written permission

8. Acceptable Use Policy

You agree not to:

Post, publish, or share illegal, offensive, or harmful content
Manipulate, hack, or interfere with the Service or its technical infrastructure
Attempt unauthorized access to other users' accounts or data
Use the Service to violate any applicable laws or regulations

9. Community Features

If the Service includes community features (e.g., forums, comments) now or in the future:

You are solely responsible for your contributions
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your contributions in connection with the Service
We reserve the right to monitor and remove content that violates these Terms

10. Limitation of Liability

The Service is provided "as is" and "as available".

To the maximum extent permitted by law, we disclaim all warranties, express or implied.

We do not guarantee that:

The Service will be uninterrupted or error-free
AI-generated content or images will be accurate or suitable for your needs
The Service will meet your expectations or be fit for a particular purpose

Legend Innova LLC shall not be liable for:

Service interruptions or technical errors
Errors or inaccuracies in AI-generated content or images
Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
Any harm, injury, emotional distress, psychological harm, or damages (including self-harm or suicide) allegedly caused by content generated by the Service
Any decisions, actions, or inactions taken by users based on content generated by the Service
The supervision or lack thereof of any minor or vulnerable person using the Service

It is not intended to provide professional advice, guidance, or information upon which users should rely for medical, psychological, legal, educational, or any other critical decisions affecting personal or professional life.

Users are solely responsible for exercising their own judgment when using the Service and for supervising any use of the Service by children or vulnerable individuals. Parents and guardians remain fully responsible for the supervision of minors' use of the Service.

11. Disclaimer of Warranties

We do not warrant:

The accuracy, completeness, or reliability of any content generated or provided via the Service
That the Service will meet your expectations or requirements
That the Service will be free of viruses or other harmful components

12. Indemnification

You agree to indemnify, defend, and hold harmless Legend Innova LLC, its affiliates, and service providers from any claims, damages, losses, liabilities, costs, or expenses arising from:

Your violation of these Terms
Your use of the Service
Your content or contributions to the Service

13. Changes to the Terms

We reserve the right to update or modify these Terms at any time.

Significant changes will be communicated via the Service or other means.

By continuing to use the Service after changes are posted, you agree to be bound by the updated Terms.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Florida, United States.

16. Apple App Store Licensing Terms

FOR USERS DOWNLOADING THE APP FROM APPLE APP STORE:

16.1 Acknowledgement

You and Legend Innova LLC acknowledge that these Terms are concluded between you and Legend Innova LLC only, and not with Apple Inc. ("Apple"), and Legend Innova LLC, not Apple, is solely responsible for the Read Legend application and the content thereof. These Terms may not provide for usage rules for the Read Legend application that are in conflict with the Apple Media Services Terms and Conditions.

16.2 Scope of License

The license granted to you for the Read Legend application is limited to a non-transferable license to use the Read Legend application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such Read Legend application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

16.3 Maintenance and Support

Legend Innova LLC is solely responsible for providing any maintenance and support services with respect to the Read Legend application, as specified in these Terms, or as required under applicable law. You and Legend Innova LLC acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Read Legend application.

16.4 Warranty

Legend Innova LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Read Legend application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Read Legend application to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Read Legend application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Legend Innova LLC's sole responsibility.

16.5 Product Claims

You and Legend Innova LLC acknowledge that Legend Innova LLC, not Apple, is responsible for addressing any claims of yours or any third party relating to the Read Legend application or your possession and/or use of the Read Legend application, including, but not limited to: (i) product liability claims; (ii) any claim that the Read Legend application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. These Terms may not limit Legend Innova LLC's liability to you beyond what is permitted by applicable law.

16.6 Intellectual Property Rights

You and Legend Innova LLC acknowledge that, in the event of any third party claim that the Read Legend application or your possession and use of the Read Legend application infringes that third party's intellectual property rights, Legend Innova LLC, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

16.7 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

16.9 Third Party Terms of Agreement

You must comply with applicable third party terms of agreement when using the Read Legend application.

16.10 Third Party Beneficiary

You and Legend Innova LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.

By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
